Client Contract and Agreement

This Agreement is made effective as of ___________________, by and between T. Nicole Johnson d.b.a. Elegant Affairs by Nicole, of 57303 Decora Park Blvd., New Haven, MI 48048 and ___________________________________________ ________________________________________________________________ .

In this Agreement, the party who is contracting to provide services shall be referred to as Elegant Affairs by Nicole and the party who will be receiving the services shall be referred to as "The wedding couple and/or agent”. Elegant Affairs by Nicole represents that they have extensive background in all aspects of the wedding/event coordination profession and access to a full range of related products and service contacts in the Greater Detroit Metro Area and surrounding area. Elegant Affairs by Nicole is willing to provide services based on this background.

To confidently create the correct and most effective package for Elegant Affairs by Nicole clients we require that all vendors are selected from our list of our preferred caterers, rental agencies, wedding officiates, ministers, musicians, bands, DJ’s, entertainment, photographers and videographers, caterers, pastry chefs, hotels, lodges, private estates and small lodging properties be used for the client to select from. The above vendors and service providers mentioned, each with their own particular areas of expertise, have demonstrated superior professionalism and service contributing to the development of a successful business relationship with Elegant Affairs by Nicole and all of our wedding clients. This factor guarantees a secure time-line in scheduling all matters for the event while keeping the client within his/her particular budget. The wedding couple or agent of couple represents that the couple plans to be married on ____________________(date) and they desire to have wedding/event coordination, and related products and services provided by Elegant Affairs by Nicole .

Therefore, the parties agree as follows:

1) DESCRIPTION OF SERVICES:

I will provide the following services: (included are details for each line item below). ·Floral/Decorations: Secure all flowers and other items required for the wedding party, decoration and other events.

·Rentals: Secure all rentals Tents, Silverware/Stemware, Cutlery, Chairs etc. Bate rate includes overseeing efficient and safe returns of all rentals. Elegant Affairs by Nicole is not responsible for damage done to or theft of rentals during your event, the wedding couple must incur any fees relating to damaged or missing rentals.

·Music and Entertainment: Secure and manage Entertainment for all events.

·Formal Wear: Help with decisions about locations to shop, purchase and style/etiquette tips. Six(6) appointments included in base rate i.e. dress selection, tuxedo selection, bridesmaid selection, final fittings. Any appointment after the sixth( 6th)incurs a $50.00 fee unless deemed an emergency.

·Transportation: Secure any shuttles, limousines, horse drawn carriages etc. including transportation to and from all events.

·Catering: Secure Food, Beverages (including liquor if not provided by venue) and Wedding Cake. Any additional wait staff/bartenders that need to be hired for food service is not included in base rate and is an additional $75.00 per person for wait staff and $150.00 for bartenders, respectively for the evening if not already provided by reception venue.

·Outside events: Any pre and post Wedding Day events are NOT included in the base rate but can be arranged for additional cost.

·Photography and Videography: Secure all photography and videography. Pick up and securing all extra prints are the responsibility of the wedding couple and/or their agents.

·Lodging/Accommodations: Make arrangements for the wedding party, family and close friends. ·Ceremony: All aspects of the ceremony will be included in base rate.

·Wedding Officiate:. Elegant Affairs by Nicole charges an additional fee ($50.00) for acquiring this service.

·Wedding/Reception Coordination: On site wedding/event coordination will be provided by Elegant Affairs by Nicole Coordination Staff. This required from date of booking through completion of events. Attendance of Elegant Affairs by Nicole at the rehearsal, ceremony and reception is required. One staff member will be present at ceremony and reception until the end of the event.

a) Elegant Affairs by Nicole agrees to provide all necessary hours of coordination prior to rehearsal and is responsible for the timeliness of services provided by all subcontractors for the wedding/event date of_____________________________.

b)The wedding couple or agent of couple agrees to utilize Elegant Affairs by Nicole exclusively for all of the above services, unless agreed upon prior to signing contract, and to provide timely responses to Elegant Affairs by Nicole inquires concerning these services. The wedding couple or agent of couple agrees that Elegant Affairs by Nicole is not responsible for any services, subcontractors or events not specifically provided by Elegant Affairs by Nicole.

2) COMPENSATION FOR SERVICES:

( a) The wedding couple or agent for the couple, agrees to pay an initial non-refundable retainer of $100.00. This payment serves, as a retainer is due and payable at the time of contract signature.

(b) The remaining payments will be billed monthly with the final payment due _______ ________________. The monthly billing will include required deposits for all services chosen, payment for coordination time at a rate of 10% of the total wedding budget and expenses incurred for any additional travel for appointments not included in base rate, postage and shipping. Billable coordination time includes time spent both on behalf of the wedding couple and time spent in communication with the wedding couple or their agents.

(c) Payments may be via cash or personal check. If your check payment is returned unpaid an automatic $50.00 charge is incurred and further services cannot be performed until balance of check amount plus return fee is paid in cash.

3) DATE CHANGES: In the event the wedding couple is forced to change the date of the wedding every effort will be made by Elegant Affairs by Nicole and staff to transfer location reservations, sub-contractors and Elegant Affairs by Nicole support to the new date. The wedding couple agrees that in the event of a date change any expenses including but not limited to deposits and fees that are non-refundable and non-transferable are the sole responsibility of the wedding couple. There may also be additional charges above and beyond those set forth in paragraph 2 above. The wedding couple further understands that last minute changes can impact the quality of the event and that Elegant Affairs by Nicole is not responsible for these compromises in quality.

4) CANCELLATIONS: In the event of a cancellation all payments made to date are non-refundable and all outstanding payments will be due immediately.

5) REMEDIES: In the event Elegant Affairs by Nicole is unable to collect the required payments for any reason the following will apply:

(a) Day 1-15: All coordination efforts will cease

(b) Day 16: All location and sub-contractor reservations made on behalf of the wedding couple will be canceled and collection efforts for any remaining debt to Elegant Affairs by Nicole will commence.

6) ACCOMMODATIONS: The wedding couple agrees that any property retained by Elegant Affairs by Nicole on behalf of the wedding couple will require a separate contract.

7) OUTDOOR LOCATIONS: The wedding couple understands that Elegant Affairs by Nicole provides certain outdoor wedding locations by special permit from the federal government or state agencies. The wedding couple agrees that they and their invited guests will abide by the permit requirements while on federal and private land. Anyone that does not abide by the rules and regulations of permits will be asked to leave and will not be re-admitted for the duration of the event. Elegant Affairs by Nicole is operated in accordance with the United States policy which prohibits discrimination on the basis of race, color, sex, age, handicap, sexual orientation, religion, and/or national origin.

8) ENTIRE AGREEMENT: This Agreement contains the entire agreement of the parties except as noted in paragraph 6 above, and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.

9) AMENDMENT: This Agreement may be modified or amended if the amendment is made in writing and is signed by both parties.

10) SEVERABILITY: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

11) WAIVER OF CONTRACTUAL RIGHT: The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.

12) APPLICABLE LAW: This Agreement shall be governed by the laws of the State of Michigan. Party providing services:
